Terms and Conditions - 25M Points Giveaway

General

1. Information on how to enter forms part of the terms and conditions of entry. Entry into the ‘25 Million Qantas Points Giveaway’ competition is deemed acceptance of these terms and conditions. Headings in this document are included for ease of reference, and do not affect interpretation in any way.

2. The Promoter is Trip A Deal Pty Ltd (ABN 50 149 240 433) (the 'Promoter'). The Promoter's address is 15 Wollongbar Street, Byron Bay, NSW 2481 (telephone number 1300 549 250) (Promoter).

Duration

3. All references to time in this document are a reference to the local time in Sydney, New South Wales, Australia on the date stated. The promotion commences at 12.01am (AEST) on 4 October 2024 and closes at 11.59pm (AEST) on 28 October 2024 (Promotion Period).

Eligibility to enter

4. Entry is open only to Australian residents who are 18 years of age or over (during the Promotion Period) who enter the competition per the entry criteria with a valid email address (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoter and its related bodies corporate.

Entry into the promotion

5. To enter, during the Promotion Period, Eligible Entrants must book (booking payment status must be set to “confirmed”) a new TripADeal Tour, Cruise, or Exclusive Hotel Package during the promotion period from tripadeal.com.au with a minimum booking value of AU$999, and depart on or prior to 30 June 2025 (Eligible Travel). Bookings for non-exclusive TripADeal Hotel Packages and Experiences are not eligible for entry in this Promotion.

6. Should an Entrant cancel the Eligible Travel booking that is connected to a winning entry, or changes their departure date to after 30 June 2025, they forfeit their entry into the competition (and accordingly, will forfeit the prize they would have won).

7. One competition entry will be issued for each eligible order. The entry will be under the primary person on the booking only, who must fit the Eligible Entrant criteria. Multiple entries per person are permitted, however each additional entry requires a new confirmed booking per the entry requirements.

8.The Promoter is not responsible for any lost, late or misdirected entries.

9.The time of entry will be deemed to be the time the entry is received by the Promoter.

10.The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Drawing of entries

11.There will be 25 winners drawn. A winner will be drawn from the Eligible Entries completed for each day of the Promotional Period. The draw for all 25 prizes will take place at 10:00am (AEDT) on Tuesday 29 October 2024 at TripADeal, 15 Wollongbar Street, Byron Bay, NSW 2481. The draw will be conducted by Trip A Deal Pty Ltd (Drawer).

12.The result of the draw is final and no correspondence will be entered into.

The Prizes

13.The total maximum notional prize pool value is AU$1,962,500 based on a sample of the Qantas Frequent Flyer Rewards that could be obtained by redeeming through the Qantas Frequent Flyer program (as fully defined in the terms and conditions of the program available at Qantas.com/terms).There will be twenty-five (25) prizes to be won in total.

14.The twenty-five (25) Eligible Entries drawn will each win a Major Prize: There will be twenty-five (25) major prizes of one million (1,000,000) Qantas Points each (Major Prize). The dispatch of the prizes will be credited to the major prize winner’s Qantas Frequent Flyer account up to eight (8) weeks from when:

  1. the winner completes their Eligible Travel during the Promotion Period, the date the winner is validated and has accepted the Major Prize; or
  2. the winner completes their Eligible Travel after the Promotion Period, the date the winner returns from their Eligible Travel order.

The maximum notional value of each of the Major Prizes (25 in total) is AU$78,500

The Promoter’s obligation to fulfil the Major Prize is conditional on the winner maintaining their Qantas Frequent Flyer account. In the event the Major Prize Winner’s Qantas Frequent Flyer membership is closed for any reason (including, but not limited to, a breach of the Qantas Frequent Flyer terms and conditions, death etc), the Promoter is released from that moment from fulfilling the Major Prize and the winner is not entitled to any further benefit or compensation.

The maximum total prize pool value of this competition is AU$1,962,500.

15. If the prize winner is not already a member of the Qantas Frequent Flyer program, membership to the Qantas Frequent Flyer program, normally valued at $99.50, will be included in their Prize. To accept this part of the Prize, the winner must not already be a member of the Qantas Frequent Flyer program, and must complete the standard join process including agreeing to the Terms and Conditions of the Qantas Frequent Flyer program (available at Qantas.com/terms).

16.The maximum notional value of the Prizes is correct as of 5 September 2024, and are provided for information purposes only. The maximum notional value of the Prizes will vary depending on whether and how it is redeemed by a winner through the Qantas Frequent Flyer program. The Promoter accepts no responsibility for any variation in the maximum notional value of the Prize.

17.The Prizes are awarded and must be redeemed, in accordance with and subject to the Terms and Conditions of the Qantas Frequent Flyer program (Qantas.com/terms), and any other TripADeal terms and conditions disclosed at the time of redemption.

18.The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.

19. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Notification of the winner

20. Winners will be notified in writing via email within two (2) business days of the draw. The winner’s last names, first initials, and postcodes will be published on tripadeal.com.au from 5.00pm (AEDT) 29 October 2024 for a minimum of 30 days. An announcement post will also be published on TripADeal’s (www.facebook.com/tripadeal) Facebook timeline at the same time.

Right of the Promoter to redraw

21. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a prize. If a prize remains unclaimed at 5:30pm (AEDT) on 12 November 2024 a second chance draw will be conducted by the Promoter on 13 November 2024 at the same time of day and location as the original draw, subject to any written direction given under applicable law. The winner/s determined in accordance with this clause will be notified by phone and in writing within 2 business days of the redraw and their last name, first initial and postcode will be published on tripadeal.com.au from 13 November 2024 for a minimum of 30 days.

Limitation of liability and variation of terms

22. If any act, omission, event or circumstance occurs which is beyond the reasonable commercial control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

23. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages)whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

24. The exclusion of liability in clause 22 does not apply to limit or exclude liability:

  1. for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or
  2. to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).

Entry details and privacy

25. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand and agree that they are providing their information to the Promoter and not to Facebook. By entering this competition, each Eligible Entrant releases Facebook from any action or claim arising out of the competition. Any questions, comments or complaints regarding this competition must be directed to the Promoter, not Facebook.

26. At all times, Eligible Entrants agree to act in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php, and other related policies.

Important information and conditions about competitions on Instagram

27. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. Eligible Entrants understand and agree that they are providing their information to the Promoter and not to Instagram. By entering this competition, each Eligible Entrant releases Instagram from any action or claim arising out of the competition. Any questions, comments or complaints regarding this competition must be directed to the Promoter, not Instagram.

28. At all times, Eligible Entrants agree to act in accordance with the Instagram Terms of Use, which can be viewed at http://instagram.com/about/legal/terms, and other related policies.

Tax Implications

29. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.

To earn Qantas Points with Qantas Tours, Members will be required to provide a valid Frequent Flyer number and last name at checkout. Only the lead traveller, the primary contact for the booking, will earn 3 Qantas Points per AU$1 spent (including GST) on eligible holiday packages. 25 Million Points Giveaway

The 25 Million Points Giveaway Offer is open to Eligible Entrants who book (booking must be paid in full) a new Qantas Tour, or Cruise during the promotion period of 12.01am (AEST) 4 October 2024 to 11:59pm (AEST) 28 October 2024 (Promotional Period). Entry is open to Australian residents over 18 only. Eligible entries require a minimum booking value of AU$999, and must depart on or prior to 30 June 2025.

Eligible Entrants who meet the entry criteria for the 25 Million Qantas Points Giveaway will also receive 5,000 Bonus Qantas Points per booking, issued to the member who has made the booking, and is valid once per order. This is in addition to the standard 3 Qantas Points earnt per $1 spent on the total booking value.

You must be a Qantas Frequent Flyer member to earn and use points. Membership is free and can be accessed via the Qantas website. The offer can be used in conjunction with bookings made using Qantas points, however the minimum cash spend required is $999, excluding Point Redemptions.

The Offer excludes non-exclusive Qantas Tours Hotel Packages and Experiences located at tours.qantas.com. The Offer does not apply to associated travel services, concierge flight tickets, travel visas, travel insurance or vouchers.
